‘Monitor CDO compliance by Sum-ag resort developer’

A resolution requesting the City Legal Office, through Bacolod Mayor Evelio Leonardia, to monitor weekly the compliance with the cease-and-desist order to the developer of a resort in a portion of the Sum-ag riverbank was passed by the Sangguniang Panlungsod Wednesday.

Authored by Councilor Carl Lopez, chairman of the SP Committee on Environment, the resolution seeks to ensure that no activities will be undertaken in the area while the CDO is in effect.

The CLO Enforcement Unit, led by lawyer Reuben Mikahail Sabig, had issued a CDO against the operations and activities being undertaken by Taculod Enterprises Inc. and Taculod for Rental Property, the developer of the resort.

Lopez said his office received several reports that Andres Taculod, owner and developer of the resort, continued with the operations despite the CDO.

Last month, a letter sent to the Environmental Management Bureau by his lawyer, Arjun Calvo, stated that Taculod will stop any further development and operation in the area until they can secure an Environmental Compliance Certificate from the Department of Environment and Natural Resources.

It also said that they will abide by the discharge permit requirements and will allow access to personnel of the DENR to conduct regular inspections in the area.

The letter was sent after EMB Region 6 director, Ramar Pascua, had issued a notice of violation against the resort development for non-compliance with the provisions under Presidential Decree 1586, or the Philippine Environmental Impact Statement System. He cited Section 4 of the law, that states that no person, partnership, or corporation shall undertake or operate any environmentally-critical project without an ECC.*
